NEW DELHI: The Delhi High Court on Friday granted an interim stay against the trial court's judgement giving chief minister Arvind Kejriwal regular bail in the liquor policy case, just hours before his expected release from Tihar jail.
The High Court threw a wrench in the AAP supremo's release, delaying it till it rendered a decision on an urgent plea challenging the bail order filed by the Enforcement Directorate. "We hear arguments. This order is on hold for the next two to three days. The implementation of the contested decision would be postponed pending pronouncement, according to a vacation bench led by Justice Sudhir Kumar Jain.
The June 20 order granting bail to the chief minister by Rouse Avenue court judge Nyay Bindu was challenged in an ED petition, and the high court ruled on it. Following the ED's request to the high court to have the bail revoked, the trial judge's 26-page order became accessible on Friday.
Kejriwal's wife, Sunita Kejriwal, accused the Central Investigative Agency (ED) of treating the AAP national convener as the “most wanted terrorist in India” shortly after the ED filed an appeal with the high court.
Your chief minister was granted bail just a day ago. The order was scheduled to be uploaded in the morning. The Delhi High Court was contacted by the ED even prior to the order being uploaded.
"Dictatorship in the country has crossed all limits," Kejriwal declared. The ED has petitioned the high court to have the chief minister's bail stayed since they do not want to provide anyone freedom.
In granting bail, the trial court judge stated that Kejriwal's guilt had not yet been proven beyond a reasonable doubt. "It's possible that some people the applicant knows are involved in an offence," she stated. However, when it comes to the applicant's receipt of criminal proceeds, ED has not provided any tangible evidence.
